Who must file
The requirement comes from the AODA and its Information and Communications standard. Three facts decide whether this deadline is yours.
- 20 or more employees in Ontario. That head count makes you an obligated organization with a filing requirement, whether you are a business, a non-profit or a public-sector body.
- The Information and Communications standard covers your website. Obligated organizations must make web content and communications accessible, and the compliance report asks you to attest to it.
- WCAG 2.0 AA is the legal floor. We audit to WCAG 2.1/2.2 AA, so you clear the legal requirement with margin instead of meeting it exactly.
What the report asks
The compliance report is a self-certification. It asks a series of questions about your organization: whether your web content meets the required accessibility standard, whether you have an accessible feedback process, and whether your accessibility policies are in place and available.
You do not submit evidence with the report. You answer the questions, and a director of the organization attests that the answers are true.
False attestation is the risk to avoid. The report is short, but the signature on it is not a formality. Answering yes to a conformance question without knowing whether your site actually conforms puts a director's name against a claim nobody has verified.
That is the practical case for auditing before filing: the audit turns the attestation from a guess into a documented statement, and we file the report with you once the answers are true.
What non-compliance risks
The statutory risk. Administrative penalties under the AODA can reach $100,000 per day for corporations. Enforcement is not the everyday experience of most organizations, but the ceiling exists and it is high.
The practical risk is procurement. Public-sector buyers increasingly require vendor accessibility conformance in their solicitations. An unfiled report, or a site that cannot back its attestation, becomes a scored weakness or a disqualifier exactly where it costs you revenue.

Do we qualify as an organization with 20 or more employees?
Count your employees in Ontario. If the number is 20 or more, you are an obligated organization and must file. If you are under 20, the accessibility standards still apply to you, but the report itself is not required.
